RESOLVED that the minutes of the meeting of the Board held on the 1st November 2001 be approved as a correct record and signed. There were no matters arising.
The Development Control Manager referred to the report especially the relevant planning history and informed Members that there was a typing error in that in June 1991 the conversion of the barn to a cottage was given full planning permission not refused as stated in the report.
As the conversion had progressed the deviation from the plans had resulted in officers calculating new build and Enforcement Notices had been issued, upheld non appeal, and currently waiting compliance. The three quarter built structure was outside the Development Limits and a number of proposals had been put forward to make use of the partially built building. This application had material differences including substantial earthworks to hide a curved roof which would be covered with earth and planted. This proposal addressed the question of visual amenity.
RESOLVED that consideration of the application be deferred in order that a site visit could be undertaken.
Mr. Stuart Owen informed Members that an e-mail had been received from Councillor W.G. Thomas that morning that stated that although he declared a personal interest as his daughter, an objector, lived in 5 Warner Place, he expressed concern regarding the maintenance of a rear access which could be adversely affected. He also pointed out that there was a possibility that the stability of the ground could be questioned due to mining activity in the area in the past. Mr. Stuart Owen proposed to include in the consent a warning that the developer should take the appropriate precautions.
Mr. Stuart Owen reported that in 1993 planning permission was given for 12 dwellings on the site of which only four had been built. This new application had reduced the number left to 7. Representations had been received from residents of Warner Place who had over the time used part of the land as a rear access to their properties. Although the proposed development included a rear lane to the properties residents felt that it would be reduced in size and any garages would need to be set back within the rear gardens. Officers were of the opinion that this was a private matter and it was not a public right of way and it would not affect planning issues. The Officer's recommendation was for approval but it would be appropriate to include a note advising the applicant that there may be a legal challenge regarding the development which may result in the deletion of one plot.
The Chair then invited Mr. Woodford Rott on behalf of the objectors to speak.
Mr. Woodford Rott informed the Board that discussions had been held with the applicant's Architect, Mr. Brendan Minney, who had advised him that the developer was considering the deletion of one plot. There was no objection to the development, in principle, and the objectors were willing to discuss the matter further with the applicant.
The Chair invited Mr. Brendan Minney the applicant's Architect to speak.
Mr. Brendan Minney informed the Board that his client would like the application to be considered as submitted and allow the objectors to pursue the legal avenues open to them.
Mr. Stuart Owen reminded the Board that if the legal challenge was successful then the validity of the planning application may need to be revisited.

Mr. Stuart Owen reminded Members that a site visit had been proposed in April 2001 but on arrival on site discussions between the residents and the applicant meant that the Board did not enter onto the site as there appeared to be an agreement that an alternative site would be more satisfactory. Since then all parties had sought other sites but none have become available. The applicant had now requested that as no alternative had become available that the original application be considered. Members were circulated with a plan of the proposed playing field. The Highways Authority were happy with the access subject to conditions. It was proposed to have landscaping between the car park and changing rooms and the dwellings with the pitch being sited on the other side of the changing rooms. Although the suggestion had been that the car park and changing rooms be positioned further away from the dwellings Mr. Stuart Owen felt that if the changing rooms were located close to the landscaping it would act as a buffer for any noise.
Mr. Stuart Owen reported that he had received a letter from the Local Member Councillor Mrs. Gwyneth Thomas who apologised for her absence but although recognised that there was a need for a football pitch in Llangennech, all attempts to find an alternative had failed. She had reservations regarding the chosen location, as there would be a loss of privacy and quiet to the street and on a highway safety ground as there could be on-street parking. Active negotiations were still continuing to find another location.
The Chair invited Mr. Eiddon Taylor on behalf of the residents to speak.
Mr. Taylor informed Members that he was representing over 30 residents who objected to the proposal. Although they recognised that the village needed a football pitch they objected to the location and layout on the grounds of road safety, litter, noise and security. Any footballs landing in the gardens could not only cause injury to people and children but also damage to properties. The erection of a fence at the bottom of the gardens did not appeal to residents as it would change the character of the area. Mr. Taylor also felt that the car parking area was inadequate and would result in cars being parked on the road which had been identified for traffic calming measures. The access road was opposite a children's playing area and with cars parked on the road then visibility for the house drives would be impaired. Mr. Taylor quoted an incident on a Saturday afternoon when the rugby team was playing at home, problems were encountered with cars being parked on the road even as far up as Pontardulais Road. He felt that the Director of Social Care and Housing supported the noise nuisance and loss of quality of life due to whistles, foul language etc. which would be clearly audible within the houses. He enquired whether a risk assessment had been carried out as to the effect it would have on the area. He felt that a change of use from grazing to a playing field that schools could use as well as a gathering place for young people, would have a detrimental effect on the quality of life of residents to the area.
Mr. Stuart Owen reported that a petition in support of the proposal had been received that morning which contained hundreds of signatures, although some were from outside Llangennech.
The Chair invited Mr. Barry Williams on behalf of the Football Club to speak. Mr. Williams pointed out that the Planning Officers were happy with the parking arrangements and felt that it would be safe. He also pointed out that a colliery used to be sited nearby and it was now proposed to locate a coal tip there. He did not feel that this application would affect the value of the houses.
Mr. Stuart Owen reported that fencing should not be placed at the rear of the gardens but in fact behind the goal line adjacent to the pitch in order to protect both the cars and the gardens. He reiterated the fact that the Highways Authority were satisfied with the proposals and they met the criteria laid down in both the Local and County Planning Policies.

Mr. Stuart Owen informed Members that Carmarthen District Council had given consent in 1972 for a caravan site of 54 units with a few being static. The latest developer had proposed building chalets which were capable of being moved and were therefore considered as caravans even though they had a brick skirt. Nine units had been developed and the landscaping had been carried out to a high quality. This was an urban development in the Towy Valley, a Special Landscape Area, but there was nothing the Planning Authority could do. The proposal was for a permanent conservatory and therefore needed planning permission. Two detached garages had been erected and a decision would be made following the Board's decision on this application whether to instigate enforcement action.

Mrs. Marlene Miles-Richards reported that a letter had been submitted that morning but it was too late to be photocopied and circulated. Having read the letter Marlene Miles-Richards was of the opinion that it contained matters that had been raised previously and circulated with the agenda.
Mr. Stuart Owen referred to the addendum wherein a letter had been submitted by the Lash Valley Protection Group and Members were given time to read it. Mr. Stuart Owen confirmed that he had received a letter from the National Assembly which referred to a request to call in two applications in the area. The National Assembly did not feel that the applications warranted calling it in and referred them back to the Board for consideration.
This was a single plot within Development Limits and the planning history showed a clear presumption for development. The Community Council and the Lash Valley Protection Group had expressed concern regarding sewers in the area. The Environment Agency recognised that there was a problem with the Blaenau/Penygroes sewer pollution for a number of years but had no objection to a single dwelling to connect at separate points. As the Environment Agency was the responsible body, the Authority had to take their views and the application could not be refused on sewerage problems. Councillor Sian Thomas reported that although she was not the Local Member the Pumping Station for the area was in her area. She had been called out there several times due to problems. She reminded Members that planning permission had been given before in the same area on the same site and questioned how many there would need to be built before it was designated as a site. Mr. Stuart Owen reminded Members that if the application was refused contrary to Environment Agency recommendations then we could not justify the refusal on a technical basis and the Authority could be liable to costs if any subsequent appeal.

The Board received and noted the written report of the Head of Planning and the Building Regulation Notices received by the Authority together with approvals/refusals issued.
The Development Control Manager reported that he had attended the Standards Committee on the 25th October with the Vice-Chair when it had been resolved to add an additional two paragraphs to the Code of Conduct to reflect Members concern regarding attendance at Community Council meetings, and the role of Members substituting at Development Control Board and Special Planning Committees. These additions had now been incorporated into the Code of Conduct and had been circulated with the Agenda for further comments.
RESOLVED that the report be noted.
RESOLVED that pursuant to Section 100A(4) of the Local Government Act 1972 the public be excluded from the meeting for consideration of the following item as it involved the disclosure of exempt information as defined within the description set out in Paragraph 13 of Part 1 of Schedule 12A to the Act, namely information which if disclosed to the public would reveal that the Authority proposed (a) to give under any enactment a Notice under or by virtue of which requirements are imposed upon a person or (b) to make an Order or Direction under any enactment.
